1. Agreement and operator

These Terms of Service (“Terms”) govern your use of the Ponz app and related services (“Service”), operated by POTE POTE LAND, LLC. (合同会社ぽてぽてランド, a Japanese company, “we” or “us”). Please read and agree to these Terms before using the Service.

2. What Ponz provides

Ponz supports learning languages such as English and Japanese through stories and conversations with AI characters. Features include the following.

Character dialogue and stories include AI-generated fiction; you are not chatting with a real person. Available features vary with the app version, language, device, and subscription.

• Choosing characters and stories, continuing chats, and conversations informed by history and memories.
• Translations, corrections, natural rephrasing, saved expressions and explanations, learning progress, and available learning courses.
• Voice input, character voice playback, free usage allowances, and the paid Ponz Premium plan.

3. Eligibility and accounts

You must be at least 13 to use Ponz. If you are a minor, you must have permission from your parent or legal guardian.

Using the app requires an account and sign-in through a method shown in the app, such as Apple or Google. Accounts support persistent conversations, memories, saved expressions and learning progress, cross-device syncing, usage and subscription management, and abuse prevention. These Terms and the Privacy Policy are available on the website before sign-in.

Provide accurate information where required. Your display name does not need to be your legal name; you may use a nickname. You may edit a name prefilled from Apple or another provider.

Keep your authentication details secure. Do not use another person's account, improperly share or transfer accounts, or impersonate others. Contact us if you become aware of unauthorized access.

4. Free usage and diamonds

Free chats use “diamonds” to manage usage. The current initial allowance is 100 diamonds, and a normal conversation exchange (your message and the AI reply) uses 5 diamonds. Included translations, basic corrections, and natural rephrasing do not cost additional diamonds. A failed reply generation does not consume diamonds.

At 00:00 UTC each day, a balance below 50 recovers to 50. A balance of 50 or more is kept unchanged. This is not an additional 50 diamonds per day, and recovery does not accumulate for days you do not use the app.

Diamonds are shared across characters and conversations on the same account. An insufficient balance prevents new messages until it recovers or you subscribe to Premium. An insufficient balance alone does not remove existing conversation history or saved expressions.

Additional diamond purchases are not currently offered. Free diamonds are not money and cannot be exchanged for cash or transferred.

5. Premium, purchases, and renewal

Ponz Premium removes the conversation-count limit for ordinary use and includes features such as character voice playback, recall of long-term memories, and detailed nuances and examples for saved expressions. Check the purchase screen for the specific benefits, price, duration, currency, and applicable taxes.

We currently offer automatically renewing monthly and annual plans. An annual plan is billed for the year in one payment; an equivalent monthly price is not a monthly installment. We do not currently offer a free trial.

Purchases are processed through the Apple App Store or Google Play. Subscriptions renew unless canceled, with charges governed by the relevant store. For Apple subscriptions, turn off auto-renewal at least 24 hours before the current period ends; renewal charges occur within the 24 hours before that period ends. Google Play renewal and billing follow its purchase disclosures and terms.

Unlimited Premium conversations cover ordinary personal use. Unauthorized access, automated bulk requests, and attempts to bypass limits may be restricted under the conduct rules below.

6. Cancellation and refunds

Cancel through the subscription-management settings of the store where you purchased. You can generally continue to use paid features until the paid period ends. Uninstalling the app or deleting your Ponz account does not by itself cancel a store subscription.

Refund eligibility and procedures follow the purchasing store's refund policy and applicable law. Use the store's refund channel to request a refund. These Terms do not limit statutory refund or other consumer rights.

Apple's Standard End User License Agreement also applies to apps obtained through the App Store.

7. AI-generated content

AI replies, translations, corrections, explanations, and memories may contain mistakes or inappropriate content. We do not guarantee their accuracy, particular learning outcomes, or the ability to remember and reproduce every detail of past conversations.

The Service is for language learning and fictional story experiences. It does not provide medical, legal, financial, or other professional advice or emergency assistance. Consult appropriate professionals or authoritative information for important decisions.

8. Prohibited conduct

You must not:

• Violate the law, commit fraud, impersonate others, or infringe intellectual property, privacy, or other rights.
• Send or request content involving sexual exploitation of minors, coercion, explicit sexual content, encouragement of violence or harm, or other inappropriate content.
• Enter someone else's confidential or personal information without the necessary authority.
• Gain unauthorized access, disrupt the Service, automate bulk requests or data extraction, or bypass safety measures, usage allowances, or payment restrictions.
• Improperly sell or share accounts or access, or otherwise interfere with safe operation of the Service.

9. Intellectual property and your input

Rights in the Service's software, official characters, story settings, images, voices, educational materials, and trademarks belong to us or the relevant rights holders. Do not copy, sell, or redistribute them without authorization except as permitted by law. Educational materials are provided for personal, non-commercial learning.

You retain any rights you have in your input. Only submit content you are authorized to use. You grant us a non-exclusive, royalty-free license to store, process, reproduce, and send that content to service providers as necessary to provide, maintain, secure, and support the Service.

We do not guarantee that AI output is unique or free of third-party rights. Respect those rights when using generated content outside the Service.

10. Privacy

Our Privacy Policy explains the information we collect, why we use it, transmission to external AI and voice providers, retention and deletion, and your choices.

11. Suspension, account closure, and service changes

We may restrict or suspend access where necessary to address violations of these Terms, abuse, or security issues.

To close your account, use account settings in the app's profile page or contact support. Contact us if an active subscription or another issue prevents in-app deletion. Cancel any subscription separately through the purchasing store. Deletion ends access to associated conversation history and saved expressions. Data handling follows our Privacy Policy.

Maintenance, outages, or changes to external providers may require changes or interruptions to parts of the Service. For significant changes to paid benefits, prices, or service conditions, we follow applicable laws and store requirements for notice and other required procedures.

12. Responsibility and statutory rights

We aim to operate the Service reliably but cannot guarantee uninterrupted or error-free availability. Our responsibility for damage attributable to us is governed by applicable law.

These Terms do not exclude or restrict rights granted under Japan's Consumer Contract Act or other applicable laws. If a provision is invalid, the remaining provisions continue to apply.

13. Changes to these Terms

We will communicate changes and their effective date through the app, website, or other appropriate means and obtain agreement where required by law. This page shows the latest revision date.

14. Governing law and jurisdiction

These Terms are governed by Japanese law. Disputes concerning the Service are handled by Japanese courts with jurisdiction under applicable law. This does not exclude rights or jurisdiction granted by mandatory consumer-protection laws where you reside.
